1. Eligibility and Use of Services

1.1. Eligibility

To access the Services, you must:
a) Have the legal capacity to form a binding contract with A to Zenith, LLC;
b) Not be barred under any applicable laws from entering such an agreement; and
c) Be at least 13 years of age. For certain paid services, including Futurist Memberships, you must be at least 18 years of age.

1.2. Entity Representation

If you use the Services on behalf of an entity:
a) You represent that you are authorized to agree to these Terms on the entity's behalf; and
b) "You" and "your" in these Terms will refer to the represented entity.

2. Privacy Considerations

Your use of our Services signifies your acceptance of our data practices as described in our Privacy Policy, accessible at [Privacy Policy URL]. This may include data transfers to various jurisdictions, such as the United States, Canada, the European Union, or other countries.

Certain premium services, such as Futurist Memberships, may require additional personal information, including payment details, which will also be subject to our Privacy Policy.

3. Content Responsibilities

3.1. Your Responsibilities

You are responsible for all content you provide and your conduct on the Services. Ensure any shared content complies with applicable laws, rules, and regulations, including intellectual property and content policies.

3.2. Content Integrity

A to Zenith, LLC does not guarantee or endorse the accuracy or authenticity of any content or communication. Be cautious of content that might be harmful, false, or misleading.

3.3. Content Management

We may remove content that contravenes our User Agreement or content policies. For more details, refer to our Help Center and Community Guidelines.

3.4. Copyright Issues

4. Ownership and Licensing of Content

4.1. Your Ownership

You retain ownership rights of the content you generate and share through the Services.

4.2. Granting License to Us

By engaging with our Services, you grant A to Zenith, LLC a global, non-exclusive, royalty-free, fully sublicensable license to use, display, distribute, modify, create derivative works from, and publicly perform or display your content across all of our platform's features. This includes, but is not limited to, content shared within the Marketplace, Jobs Board, Multimedia Hubs, Tools, Forums, Hubs, and any other interactive areas of the platform.

This license also extends to the following:

  • Futurist Membership Features: Content shared as part of paid services or exclusive features available to Futurist Members will be subject to the same license for use across premium features of the platform. This includes, but is not limited to, exclusive articles, educational materials, multimedia content, and collaborations created as part of Futurist Membership privileges.
  • L.E.A.R.N. Continuing Education Program: Content you contribute, including but not limited to course materials, assessments, quizzes, videos, and presentations, may be used, modified, and distributed in connection with our L.E.A.R.N. Continuing Education Program. Your content may be adapted for use in online courses, training modules, and other educational offerings available to the global community of professional surveyors.
  • Marketplace: Any content you upload or submit related to products, services, listings, or materials in the Marketplace will be used for display, advertising, and promotion within the Marketplace and potentially across other sections of the platform for marketing purposes.
  • Jobs Board: Any content related to job postings, CVs, applications, or other career-related materials submitted through our Jobs Board may be displayed, adapted, and used in connection with job opportunities, employer promotions, and career development resources provided on the platform.
  • Multimedia Hubs: Content uploaded to our Multimedia Hubs, including images, videos, presentations, and audio files, may be displayed, shared, and promoted both within the platform and externally through marketing, social media channels, and content partnerships. This includes use in platform-wide events, campaigns, and highlights that promote user-generated content.
  • Tools and Services: Content shared in connection with the platform’s various tools and services (including calculators, mapping tools, software integrations, etc.) may be used to improve the tools themselves, as well as in tutorials, community guidance, or other platform-related resources.
  • Community Contributions and Hubs: Content you submit to the various Community Hubs, forums, or user collaboration areas (such as professional groups or geographic hubs) may be displayed publicly or privately within the platform based on your privacy settings. This content may be used to foster discussions, highlight community activities, or promote professional collaboration on the platform.
  • Advertising and Marketing: We may use your content for marketing and promotional purposes across our platform, including in connection with our Futurist Membership, L.E.A.R.N. Program, Marketplace, Multimedia Hubs, and more. This includes featuring user-generated content in external campaigns, advertisements, and sponsored content to promote the platform and its services.

By granting this license, you acknowledge that A to Zenith, LLC may modify your content (for example, resizing images, translating content into other languages, or adapting it for various formats) in order to ensure optimal display and functionality across all devices, regions, and platform features. We will not alter your content in a way that misrepresents its original intent, except for formatting or technical purposes, and any significant changes will be discussed with you in advance if necessary.

You further agree that this license remains in effect as long as your content is available on the platform, even if you choose to terminate your account, unless otherwise specified in separate agreements, such as those governing Futurist Membership or L.E.A.R.N. Program contributions. Content may be retained for archival, compliance, or legal purposes where necessary.

4.3. Content Adaptations

We may adapt, edit, or reformat your content for various distribution channels, including social media, marketing, or educational purposes, such as the L.E.A.R.N. Continuing Education Program.

4.4. Your Representations

You represent that:
a) You possess the requisite rights to your content;
b) You have procured the necessary permissions; and
c) Your content does not infringe any third-party rights.

5. Service Usage Guidelines

5.1. Adherence to Policies

Users must adhere to our Rules and Policies, which are integral parts of this User Agreement. We reserve the right to enforce these guidelines, including those related to the Marketplace, Jobs Board, Multimedia Hubs, and Futurist Membership features.

5.2. Service Evolution

The Services may undergo modifications, and we may alter, pause, or cease any feature or the entirety of the Services for various reasons, including legal compliance, user safety, or service upgrades. These changes may affect the availability of L.E.A.R.N. Continuing Education Program, Marketplace, and other features.

5.3. Advertisements and Information Disclosure

Advertisements might appear alongside your content. We may access, retain, or disclose information for reasons such as legal compliance, marketing, or user safety. Refer to our Privacy Policy for more information on data usage.

5.4. Additional and Specific Service Terms

Some platform features may require agreeing to supplementary terms. These may include the Marketplace, Jobs Board, Futurist Membership, L.E.A.R.N. Program, or any other specialized service. In the case of conflicts, specific service terms prevail.

5.5. Paid and Developer Services

Engaging with paid services, such as Futurist Membership upgrades or developer APIs, requires agreeing to their specific terms, which may include additional fees, data usage, and other requirements.

6. Account Responsibilities

6.1. Account Creation

Certain Services, including the Futurist Membership and L.E.A.R.N. Continuing Education Program, require creating an account. Protect your account with a strong, unique password. We disclaim responsibility for unauthorized access resulting from weak security measures or negligence.

6.2. Communication Preferences

Certain communications related to your account or the Services are mandatory. Ensure that your contact details, including email addresses and phone numbers, are accurate and up to date to receive important notifications about updates, changes, or service interruptions.

7. Licensing and Service Access

7.1. Licensing

We grant you a personal, worldwide, royalty-free, non-transferable, non-exclusive license to use the software provided as part of our Services. This includes features accessible through the Futurist Membership, Marketplace, Jobs Board, and Multimedia Hubs.

7.2. Intellectual Property

Our Services, including tools, logos, content, and software, are protected by intellectual property laws. Unauthorized use of A to Zenith, LLC's trademarks, logos, or other proprietary information is strictly prohibited.

8. Prohibited Actions

Misuse of our Services, including unauthorized access, data tampering, software modification, or abuse of tools like the Marketplace, Jobs Board, or Futurist Membership benefits, is strictly prohibited. Encouraging or aiding in such actions also constitutes a breach.

9. Termination of Agreement

9.1. Your Right to Terminate

You can terminate this agreement by deactivating your account and ceasing to use the Services. For users enrolled in the Futurist Membership, termination of membership may involve additional conditions outlined in the membership terms.

9.2. Our Right to Terminate

We reserve the right to suspend or terminate your account or restrict access to our Services due to breaches of the Terms of Service, legal risks, prolonged inactivity, or other reasons. If your account is associated with a Futurist Membership, any fees or payments already made may not be refundable.

10. Liability Restriction

By using our Services, you acknowledge that A to Zenith, LLC's liability is limited to the maximum extent allowed by law in your jurisdiction. This includes any limitations related to your participation in the L.E.A.R.N. Program, Futurist Membership, or other platform services.

11. General Provisions

11.1. Terms Revision

We may occasionally revise these Terms of Service. Your continued use of the Services post-modification indicates your acceptance of the updated terms.

11.2. Class Action Waiver

Both parties waive any rights to participate in class action lawsuits related to these Terms of Service.

11.3. Language Precedence

Translations of these terms are provided for convenience. In case of discrepancies, the English version prevails.

11.4. Enforceability

If parts of these Terms of Service are found unenforceable, the remaining portions remain in effect.

12. Reference to Other Legal Documents

By using our Services, you acknowledge and agree that additional legal documents may apply to your use of the platform, including but not limited to the Privacy Policy, Community Guidelines, Payment Terms, and Futurist Membership Terms.     By using our Services, you acknowledge and agree that these Terms of Service constitute a legally binding agreement between you and A to Zenith, LLC. This agreement, however, may not include every legal obligation associated with your use of our Services. Additional obligations may be specified in other documents, including but not limited to:

All policies and legal agreements available on our legal webpage at https://www.atozenith.co/legal are incorporated by reference and form part of the binding terms governing your use of our Services. By continuing to use our Services, you agree to abide by these Terms of Service as well as all referenced policies, guidelines, and agreements, which together represent the entirety of the terms governing your rights and obligations.

It is your responsibility to review and comply with all applicable terms, policies, and agreements. Failure to adhere to any of these terms may result in the suspension or termination of your access to the Services. Continued use of our Services following any updates to these agreements constitutes acceptance of the revised terms.



The following Terms of Service apply to your use of this Network. You are solely responsible for your conduct and your content on the Network and compliance with these terms. By registering with us or using or browsing this Network, you acknowledge that you have read, understood, and agree to be bound by these terms. This Network is not intended for children younger than 16 and is offered only to users 16 years of age or older. You may use this Network provided that you have the power to enter a binding contract with us and are not barred from doing so under any applicable law of your country.

You agree that you will not post, email or make available any content or use this Network:

  • In a manner that infringes, violates or misappropriates any third party's intellectual property rights or other proprietary rights or contractual rights;
  • in a manner that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • to engage in spamming, "chain letters," "pyramid schemes", advertisement of illegal or controlled products or services, or other advertising or marketing activities that violate these Terms of Service, any applicable laws, regulations or generally-accepted advertising industry guidelines;
  • in a manner that is misleading, deceptive or fraudulent or otherwise illegal or promotes illegal activities, including engaging in phishing or otherwise obtaining financial or other personal information in a misleading manner or for fraudulent or misleading purposes;
  • in a manner that is libelous or defamatory, or in a way that is otherwise threatening, abusive, violent, harassing, malicious or harmful to any person or entity, or invasive of another's privacy;
  • in a manner that is harmful to minors in any way;
  • in a manner that is hateful or discriminatory based on race, color, sex, religion, nationality, ethnic or national origin, marital status, disability, sexual orientation or age or is otherwise objectionable;
  • to impersonate any other person, or falsely state or otherwise misrepresent your affiliation with any person or entity, or to obtain access to this Network without authorization;
  • to interfere or attempt to interfere with the proper working of this Network or prevent others from using this Network, or in a manner that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to this Network, or that otherwise negatively affects other persons' ability to use this Network;
  • to use any manual or automated means, including agents, robots, scripts, or spiders, to access or manage any user's account or to monitor or copy this Network or the content contained therein;
  • to facilitate the unlawful distribution of copyrighted content;
  • in a manner that includes personal or identifying information about another person without that person's explicit consent;
  • in a manner that employs misleading email or IP addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content transmitted through this Network or to users; and
  • in a manner that constitutes or contains any form of advertising or solicitation if emailed to users who have requested not to be contacted about other services, products or commercial interests.

Additionally, you agree not to:

  • "Stalk" or otherwise harass anyone;
  • Collect, use or disclose data, including personal information, about other users without their consent or for unlawful purposes or in violation of applicable law or regulations;
  • Request, solicit or otherwise obtain access to usernames, passwords or other authentication credentials from any member of this Network or to proxy authentication credentials for any member of this Network for the purposes of automating logins to this Network;
  • Post any content containing child pornography to this Network;
  • Post any content that depicts or contains rape, extreme violence, murder, bestiality, incest, or other similar content;
  • Post any content that constitutes pornography, contains nudity, or is adult in nature.
  • Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from this Network - except for Internet search engines (e.g. Google) and non-commercial public archives (e.g. archive.org) that comply with our robots.txt file, or "well-behaved" web services/RSS/Atom clients. We reserve the right to define what we mean by "well-behaved";
  • Post irrelevant content, repeatedly post the same or similar content or otherwise impose an unreasonable or disproportionately large load on the Network's infrastructure;
  • Attempt to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, this Network;
  • Use this Network as a generic file hosting service;
  • Take any action that may undermine the feedback or ratings systems (such as displaying, importing or exporting feedback information off of this Network or for using it for purposes unrelated to this Network); and
  • Develop, invoke, or utilize any code to disrupt, diminish the quality of, interfere with the performance of, or impair the functionality of this Network.

You agree not to authorize or encourage any third party to use this Network to facilitate any of the foregoing prohibited conduct. You also agree that these Network Terms of Service inure to the benefit of our service providers (including our Network platform provider) and that they may take action (including the removal of your content and disabling of your account) in order to maintain compliance with these Network Terms of Service. Technology and hosting for aspects of this Network are provided by this Network's online service provider. However, the Network Creator of this Network controls the content, membership and policy of this Network, including those pages served by such service provider on behalf of this Network.
